KMP property attached over unpaid salaries

MUTARE - The Deputy Sherriff has attached Kubudirira Marketing (Pvt) Ltd property to recover over $15 000, 00 owed to workers in underpayments and terminal benefits.

KMP failed to comply with an Arbitral Award passed in favour of its 22 construction workers in December 2010 by the National Employment Council (NEC) for the Construction Sector for wage arrears accrued through underpayments for the period February 2009 to September 2009 and terminal benefits of the workers after their employment was summarily terminated in September 2009. The arrears had accumulated to $15 810,10.

Representing the workers in the matter, the Zimbabwe Construction and Allied Trades Workers Union (ZCATWU) through the union’s lawyers, Ralph Magan’a and Associates successfully registered the Award at the High Court in July 2012 where the Deputy Sheriff was ordered to attach the company’s property.

On the 11th of February this year, the High Court Deputy Sheriff based in Mutare proceeded to the company and attached KMP property worthy $15 663.

The property attached is mostly composed of office equipment which included 1 upright fridge, 8 piece detachable car bots, 7 piece table, sonny TV, apple computer system, 5 detachable glass tables as well as office chairs.

‘’You are required and directed to attach and take into execution the movable goods of KMP Construction, to realise the sum of US$ 15 810.10 to be paid to Chrispen Chiwanga & 21 other mentioned Applicants which they recovered by Judgement of Honourable Court dated the 28th of June 2012,’’ stated the Register of High Court in an order witnessed by the Chief Justice Godfrey Chidyausiku.ZCATWU Regional Officer confirmed the development and explained that the union finally enforced for the attachment successfully after a series of hindrances’ with a previous deputy sheriff operated in Mutare identified as Dzobo since 2012.

‘’The employer was adamant in refusing to own up the debt through a payment plan outside the courts and this forced us to choose the legal route. We had problems with some other messengers of court operating in town since 2012 when the order was granted to effect the executions in the yesteryears but as systems changed the High Court Deputy Sheriff made the work easier and successfully, ‘’ he said. 

The High Court Deputy Sheriff confirmed that the property would be put under the auction hammer when the company fail to offset the debt within the stipulated period.
